The social partners have reached consensus on new Codes of Good Practice on Collective Bargaining, Industrial Action and Picketing (codes), & proposed changes to the LRA on dispute resolution and picketing.

This one-day workshop aims to provide participants with key insights on how best to take advantage of the codes & lay foundations for mutually beneficial collective relationships.

The Codes are not binding but rather aim to change behaviours & encourage bargaining partners to do things differently. Success will depend on how parties prepare & adapt their new or renewed relationships using the guides.

The Workshop will be interactive & cover sections on: –

  • Knowledge & understanding about the new Accords.
  • Tips & ideas on translating the Codes into new generation recognition agreements & subsidiary rules, such as those relating to pickets.
  • Bringing needs-based bargaining to life, including the importance of joint preparation about negotiations, what it means to commit to good faith bargaining, how this impacts on rational demands and settlement areas, & the relevance of having roadmaps from initial proposals to final agreements.  Indicators will be given about key clauses to be introduced into settlement agreements.
  • Handling deadlock in negotiations, including defining areas of agreement & disagreement
  • The role of alternative dispute resolution.
  • Ideas for ensuring peaceful industrial action, pickets & the role of public order police.

Mike and Nerine will share practical lessons and realistic expectations about possible changes in behaviours based on their own experience in collective disputes.
